1. Scope of application

All Orders, services and offers performed by Trianera.com shall be carried out solely on the basis of the following General Terms and Conditions. These terms and conditions are an integral part of all the contracts on any item made in the online shop made between Trianera.com and the customer. We shall not accept provisions in derogation of these terms unless they have been confirmed by Trianera.com in writing.


2. Services

You can order online flamenco articles in our online shop.


3. Contractual languages

Contractual languages are Spanish, Japanese amd English.


4. Order transaction / modifications / cancellations

The product description in the online shop is not a legal binding product offering but a non-binding online catalogue.
By entering his data and clicking the ordering button at the final step of the ordering process the buyer places a binding order of the chosen goods. For this purpose a confirmation window with your ordering details will open before ending the ordering process, where you can supervise and modify your order data.
After placing your order Trianera.com  will send an email to you confirming that the order was received (Order Confirmation). A binding contract of sale shall come into being when Trianera.com  confirms your order. Your contractual partner is Trianera.com.

After placing the ordering you can check your order data in 'My account' at anytime.
Order modifications include changes in style, measurements, or fabric and adding or removing items from your order. If your order is already being tailored or sewn by our factory, modifications will not be allowed.
We cannot grant the possibility of cancelling your order once you have paid for it as FlamendoShop.es may have had costs if we have already started tailoring or sewing the garment/s corresponding to the order.
If you want to modify/cancel your order, contact us and we will inform you of your order status to determine if this is possible.
An unpaid order will be deleted from our database after 7 days.


5. Return policy

Trianera.com wishes to offer the best possible service. That is why you would be able to return any ready-made product that has been delivered to your address by contacting administrator@trianera.com. Such return will meet the following conditions: the product will be in perfect shape, the product will be packed in its original packing and delivery costs will be on your account, in accordance with current regulations.

All our products are carefully handmade so that we can offer a perfect fit for every client. In order to satisfy each of our clients, if a mistake is made, we will send a new product with the appropriate modifications as a replacement. However, Trianera.com will not refund the paid amount in any case.

Trianera.com will send a new product in the following cases:
    The chosen fabric does not match with the received garment (Note: Differences due to screen effects are not considered for replacement, fabric colour can vary between 5-10%)
    The product configuration does not match with your order.
    The size used on your product does not correspond with your order.
Because our garments are handmade, measurements may vary slightly. We do not consider slight variations in measurement for return.

Trianera.com cannot guarantee the correct measure taking by the customer. Therefore we will not accept returns on garments which measures have been incorrectly taken by the user.
Before a return is processed, the faulty garment must be returned so that our incidence team can verify the incorrect order and send out the replacement.
We will not accept any return of garments that have been manipulated or modified by the customer (i.e. silk-screen, washing, embroidery, etc).

6. Delivery/ Transportation

Trianera.com guarantees start the delivery process 7 days after the payment process is complete. The carriers contracted by Trianera.com on behalf of the customers estimate delivery time to be 9-10 days. Your order should arrive between 15 and 20 days after it has been placed.

However, because shipments are made by third parties, Trianera.com will not be held responsible for possible shipment delays.
Trianera.com subcontracts carriers and, therefore once the carrier is in charge of the package, the only information we have access to appears on the carrier’s website.
Trianera.com will not be held liable for events or circumstances beyond our control. Trianera.com will not take responsibility for any human/mechanical/technical errors, shipment delays, courses of nature, custom procedures* or lack of availability of the customer at the time of delivery.
All purchases made through Trianera.com include a shipment contract and when the order is in the carrier´s hands the carrier is responsible for it.


7. Pricing and delivery costs.

Prices are valid as shown on the website when the order is processed. All prices are in euros and include sales tax (VAT) if applicable.
Delivery costs are added extra.

8. Payment

You can choose between the following payment methods :

• Paying with Paypal
You can easily pay with the following credit cards: Visa, MasterCard and American Express. The data transfer is encrypted by making use of a secure 256 bit SSL-transmission.

• Paying by bank transfer
Simply transfer the stated sum to our bank account. You will get our bank details by e-mail.

9. Retention of Title

The goods are and remain property of Trianera.com until the complete payment of the invoice sum is made.


10. Warranty

The current legal rights will be applied in case of a defect in the delivered item. Any claim due to damages and losses will be ruled in accordance with the stated rules in the present conditions.


11. Copyright

You may not use, duplicate or republish particularly the copyrighted content included in this Site (especially texts, pictures, graphics, designs, etc.) without expressed written consent from Trianera.com.


12. Duty of secrecy and security

The orders as well as the personal information given by the customers will be recorded by Trianera.com.
These data will be only used and processed within the scope of the applicable Data Protection Act. All personal data, like the address, and all credit card data are encrypted by making use of a SSL-transmission in order to secure the transfer of data through the internet.


13. Applicable Law

The Web Site is operated and controlled by Trianera.com from their office in Spain. Therefore it will be understood that all matters that could derive from the access and/or use of the site will be interpreted according to the Spanish Law.
In the event that the user had his/her address elsewhere out of Spain, Trianera.com and the user shall submit, expressly waiving any other jurisdiction, the competent Courts in the Kingdom of Spain.


14. AOB (Any other Business)

Should individual clauses in these conditions be or become invalid, the validity of the other clauses or the other parts of such clauses shall remain unaffected.
